These General Terms and Conditions ("General Terms") constitute a legal agreement between you, the User or Customer of any of our Services ("Customer," "you," or "your"), and RAWAD AL-TAMWAH Digital Marketing, established and registered in the Kingdom of Saudi Arabia ("KSA") under commercial registration number 1009083064, with its principal office located in Riyadh City ("RAWAD," "we," "us," or "our"). These General Terms govern your use of our Services. By accessing or using our Services, you agree to abide by and be bound by these General Terms. You also confirm that you have reviewed and understood our Privacy Policy and any other applicable policies. If you do not accept any part of these General Terms, please refrain from using or accessing our Services.


BY CHECKING THE ACCEPTANCE BOX, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS AND REPRESENT THAT YOU HAVE THE LEGAL AUTHORITY TO ENTER INTO THIS BINDING AGREEMENT, WHICH CREATES LEGAL OBLIGATIONS FOR THE ENTITY. IF YOU LACK SUCH AUTHORITY, DO NOT ACCEPT THESE GENERAL TERMS.


1 Definitions:

The following terms mean for the purpose of these General Terms as defined below:

1.1 Applicable Policies: Refers to the policies, terms and conditions, and any rules governing the Services, as adopted or determined by us. These policies are subject to periodic review and may be updated, amended, replaced, or withdrawn at Rawad's sole discretion.

1.2 Business Day: Any day when banks are open for business within KSA, excluding weekends and public holidays.

1.3 Transaction Date: Refer to the date of your sale transaction conducted on Rawad's Platform.

1.4 Month(s): Refers to the twelve months in the Gregorian calendar, starts from January until December.

1.5 Return Period: refers to the fourteen days (14 days) beginning from the Transaction Date on which you have the right to terminate or return the Services.

1.6 Platform(s): Refer to all Rawad's websites, applications, including Anan. Rawad retains the right to include or exclude any web portal from the scope of this concept.

1.7 Service(s): Refers to the marketing, promotion, and facilitation efforts conducted by the platform to connect Customers with Offerings by Service Providers. The service includes, but is not limited to, listing, advertising, and promoting these offerings through various channels, facilitating transactions, and enabling communication between users and Service Providers. The platform itself does not provide or execute the activities, programs, or services but acts as an intermediary in connecting users with Service Providers.

1.8 Service Provider(s): Refers to any registered third-party individual or entity that lists Offerings through Rawad's Platforms. The Platform’s role is to facilitate connections between Service Providers and users, without directly delivering or being responsible for the underlying activities or services offered independently by the Service Provider.

1.9 Service Coverage Area(s): Refers to the geographical region or scope within which Rawad Services provided to market or promote Offerings through the Platform. Rawad serve mainly Service Providers within KSA and may extend to other countries and regions as presented in the Offerings' provided information.

1.10 Offering(s): Refers to the activities, programs, or services that the Service Provider agrees to market through the Platform, including extracurricular programs, sports training, or workshops.

1.11 Customer: Refers to any individual who is at least eighteen (18) years old, or has otherwise reached the age of majority in their jurisdiction, who uses our Platform(s) to book or access Offerings for themselves or on behalf of minors under their legal guardianship or authorized care.


2 Acknowledgments:

2.1 You hereby represent and acknowledge that you are at least eighteen years old, you are within our Service Coverage Areas, you possess the legal and actual, capacity, eligibility, and ability to register and use our Services.

2.2 Any information you provide to us is up-to-date, correct, and accurate and represents yourself.

2.3 You will use Rawad's Platforms to enter transactions that are legitimate and in compliance with applicable laws.

2.4 You acknowledge that you are accepting these General Terms with required legal permission(s) to conduct transactions, including sufficient parental permission if required by law in transactions you conduct with us.

2.5 You hereby acknowledge these General Terms represent a valid and effective agreement between you and Rawad.


3 Use and Account Registration

3.1 You may access our Platforms to learn about our Services and the available Offerings.

3.2 Registration on the Platform is required prior to booking any Offering.

3.3 During the account registration process, you shall provide accurate, true, complete information, including your name, age, city, cellphone number, and Email address.

3.4 You may create sub-accounts or profiles for children under their legal guardianship or authorized care ("Child Profile(s)"). When setting up a Child Profile, the adult user ("Parent/Guardian") may provide relevant child-related information, including but not limited to: Name, Age, Interests and preferences, Health information (if necessary for participation in certain activities), Special requirements or restrictions. The Parent/Guardian is responsible for ensuring the accuracy and completeness of any details entered in the Child Profile(s).

3.5 We reserve the right to hold, limit, or terminate your account, including the Child Profile, without providing a reason with a prior notice of five Business Days. We reserve right to hold, limit, or terminate your account immediately and unilaterally if you fail to provide us with correct information and/or comply with applicable laws and policies, including these General Terms.

3.6 You reserve the right to deactivate your account at any time, provided that such right is exercised in accordance with and subject to the limitations and conditions set forth in other provisions of this agreement.


4 Modifications and Revisions

4.1 We reserve the unilateral right to modify, revise, update, and/or interpret these General Terms at our discretion.

4.2 The recent version of the General Terms shall apply to your use of our Services and your transactions on our Platform, regardless of the date of access, acceptance, or interaction. It is your responsibility to review and stay informed of the latest version available on our Platform. Your continued use or access to our Platform and Services constitutes acceptance of any amendments, updates, or interpretations.

4.3 Our modifications and revisions may extend to restructuring these General Terms and add further policies. Each policy shall govern within its defined scope and if a conflict exists, we reserve the authority to interpret and determine the applicable rule.


5 Unlawful Use 

5.1 We have developed our Services for legitimate uses of Customers and Service Providers. Rawad does not share or bear responsibility for illegal use of Customers and Service Providers.

5.2 We have worked on compliance with applicable laws within the Service Coverage Areas. However, Rawad does not guarantee that your particular situation is compliant with the applicable laws. You shall use our Service with reasonable caution and in a fully responsible manner.

5.3 Customers are prohibited from engaging in illegal, harmful, or prohibited activities, including any actions that violate the General Terms, Applicable Policies, and/or the applicable laws. Providing false, misleading, or inaccurate information when selecting or booking offerings is strictly prohibited. Misuse of platform resources, such as unauthorized access or any action that disrupts the Platform’s operation, is not allowed.

5.4 The security of your account is your responsibility, and all violations committed through your account are you responsibility, unless proven otherwise. Customers must not violate privacy rights by collecting or sharing personal information without authorization or abuse the review system by submitting fraudulent or misleading reviews. 

5.5 Committing a conduct that Rawad unilaterally consider it unlawful use may result in the immediate hold or termination of your account. By engaging in prohibited activities, you waive your right to request refunds and service credits or rewards.


6 Platform Services and Responsibilities

6.1 The Platform serves as an intermediary, connecting Customers with various Offerings by third parties. The Platform does not directly offer or manage these offerings; all obligations related to delivering the activities reside with the respective Service Provider.

6.2 The Service Provider provides Offerings as independent third-party Service Providers. The Platform neither supervises nor directs the services offered by these independent contractors and disclaims all liability for their performance. The Platform assumes no responsibility for the quality, safety, or execution of any activities provided by Service Providers.

6.3 Service Providers are expected to maintain high standards of quality and ensure their personnel are suitably trained and certified to provide the offered activities. Service Providers must comply with all applicable health and safety regulations, ensuring that venues and facilities are appropriately maintained and safe for participants. If a Service Provider receives recurrent negative feedback, fails to meet agreed-upon standards, or is subject to repeated complaints, Rawad reserves the right to remove or suspend the Service Provider’s listing on the Platform. 6.4 Service Providers are obligated to comply with the Platform policies, we are not responsible for any violations by Service Providers, including failure to deliver services, misrepresentation of Offerings, or engaging in unlawful activities. Customers should exercise caution when selecting offerings and verify details before booking or engaging in any service. 


7 Booking Process

Customers may select and reserve Offerings by following the booking steps provided on the Platform. Bookings are subject to availability and acceptance by the relevant Service Provider. Confirmation is issued via the Platform or email once accepted.


8 Payments and Fees

The User agrees to pay for services at the time of booking, with payments processed through third-party payment gateways facilitated by Anan. The total amount displayed during checkout includes any transaction fees or taxes you may bear.


9 Cashback Rewards Program

• The cashback rewards program allows Users to accumulate rewards from eligible bookings..

• These rewards can be used toward future bookings on the platform and are applicable regardless of the amount accumulated.

• Rawad retains the sole discretion to determine whether to grant rewards, how many rewards are granted, and the duration for which such rewards remain valid.



10 Cancellations, Refunds, and No-Show Policy

10.1 The User may cancel a booking as displayed at the time of booking; however, if a cancellation is made after the specified deadline, the User may no longer be eligible for a refund. This provision does not obligate Rawad to display any particular information, such as cancellation policies, and, if such information is not provided, the Service Provider’s terms shall prevail.

10.2 In the event that the services provided by a Service Provider do not conform to the descriptions provided or fail to meet reasonable standards of quality, Anan reserves the right to issue a refund to the Customer. This right is exercisable upon receipt of a valid complaint from the Customer regarding the deficiency in service quality. Anan is committed to ensuring customer satisfaction and maintaining trust in the services advertised on our platform.

10.3 If the Customer fails to attend a booked activity without prior cancellation, the booking fee shall not be refunded.

10.4 Under Anan’s cancellation policy, users may cancel up to 48 hours before the scheduled start of the activity for a full refund, minus any processing fees. Cancellations made between 24 and 48 hours prior are eligible for a 50% refund, minus applicable fees. Cancellations made less than 24 hours before the activity are non-refundable. If the service provider has their own cancellation policy, it will supersede Anan’s policy, and users must comply with the provider’s terms.




11 Data & Privacy

11.1 By accessing our Services, you confirm that you have reviewed and accepted our Privacy Policy. This policy explains how we collect, use, and protect your personal information.

11.2 You agree to submit information that is accurate, lawful, and complete. While we are not obligated to monitor your data, we retain the right to delete or remove any data at our discretion without prior notice.

11.3 By using our Services, you grant us, along with its affiliates, parent company, and subsidiaries, the right to utilize anonymized and de-identified data for service improvements, research, and analysis. Even if your account is deleted, we may continue to use aggregated data that does not personally identify you for marketing or research purposes.

11.4 Rawad will collect and process personal information related to you and your children in accordance with our Privacy Policy and applicable laws. This may include details provided when creating child profiles, booking activities, or otherwise using our Services. You agree that children’s personal information, including profile data, may be shared with Service Providers as necessary to facilitate bookings and deliver services. Anan takes reasonable precautions to safeguard all personal information, including that of minors, against unauthorized access or disclosure. However, we cannot guarantee absolute security. You acknowledge and agree that Anan is not liable for any unauthorized access resulting from your failure to safeguard account credentials, including passwords or other login details.


12 Liability and Compensation

12.1 Rawad, including its parent company, subsidiaries, officers, directors, employees, affiliates, agents, and licensors, shall not be held liable for any form of damages arising from or related to the use of our Services. This includes, but is not limited to, loss of profits, data, business interruption, or booking failures, even if Rawad has been advised of the possibility of such damages. Where applicable law imposes limitations on liability, this clause applies to the fullest extent permitted.

12.2 Rawad acts solely as an intermediary platform, connecting Users with independent third-party Service Providers who offer extracurricular activities or other services. Rawad neither manages nor oversees the services offered by these independent contractors and assumes no liability for any claims, damages, or liabilities arising from their performance. Rawad is not responsible for any inaccuracies, errors, or omissions in the content or listings of Offerings provided by Service Providers. Decisions regarding the selection or booking of Offerings are at the sole discretion of the Customer, and Rawad does not guarantee the quality, safety, or outcomes of any Offering facilitated through the Platform. Any disputes, issues, or claims regarding third-party services must be resolved directly with the respective Service Provider.

12.3 The Customer acknowledges and agrees that any participation by a minor in activities booked through the Platform is at the Customer’s sole risk. The Platform assumes no responsibility or liability for injuries, losses, or damages arising from or related to either adult or child participation in Offerings provided by Service Providers. The Platform bears no liability for any loss, damage, or injury resulting from the Customer’s use of the Services, including those involving minors. Furthermore, the Customer agrees to defend, indemnify, and hold the Platform (including its affiliates, officers, directors, and employees) harmless from any claims or demands arising out of the Customer’s use of the Platform or any breach of these Terms.

12.4 In the event that liability is established under any legal grounds, Rawad’s maximum aggregate liability under these Terms or in connection with your use of our Services shall not exceed the total amount you have paid for bookings through the Platform in the preceding twelve (12) months.


13 Intellectual Property Rights:

Rawad holds full ownership of all intellectual property related to our Services, including the logo, all content such as photos, videos, audio clips, video segments, written material, user interfaces, and the underlying scripts and software used to deliver our Services. Users are granted a limited, non-exclusive, and revocable license to use our Services. Any submissions, including ideas, feedback, or communications regarding our Services, whether solicited or provided voluntarily, do not create any obligation on our part to use or act on such submissions, and no compensation is required. By submitting such materials, you agree that they become the exclusive property of Rawad.


14 Communications:

By agreeing, you consent to receiving communications from us, such as emails, text messages, and phone calls, through the contact details associated with your account. It is your responsibility to ensure that the contact information in your account or any other information you provide is accurate and up to date. All communications regarding our Services, including inquiries, reports, concerns, and questions, should be conducted privately through the communication methods we specify.


15 Governing Law:

These Terms shall be governed by, and construed in accordance with, the laws of the Kingdom of Saudi Arabia.


16 Dispute Resolution

16.1 Rawad maintains a complaint system that must be used as the initial channel for any claims. Please ensure your claim is submitted through this system before pursuing any other course of action.

16.2 In the event of any dispute or disagreement between the parties regarding the interpretation or execution of these Terms, the party raising the dispute shall provide written notice to the other party, specifying the nature and details of the dispute. No legal proceedings shall be initiated by either party until the notice procedure outlined herein has been fully complied with. Upon receipt of the dispute notice, the parties shall, within twenty business days, engage in good faith negotiations through their authorized representatives to resolve the dispute. If the dispute remains unresolved within sixty (60) business days from the receipt of the notice, either party may, upon providing notice to the other party, submit the dispute to commercial arbitration in accordance with the regulations of the Saudi Center for Commercial Arbitration. The arbitration shall be conducted in Riyadh, Kingdom of Saudi Arabia, and the decision rendered by the arbitrator(s) shall be final and binding upon both parties.

18 Language of these Terms:

These Terms are drafted in both Arabic and English. The English version is a translation of the Arabic version. In the event of any inconsistency or conflict between the two versions, the Arabic version shall prevail and take precedence.


19 Miscellaneous:

19.1 These Terms constitute the entire understanding regarding the subject matter herein between you and Rawad and supersede all prior and current, written or verbal promises, commitments, agreements, representations, warranties, and understanding, unless a written agreement expressly agreed upon by both parties is established to modify or replace certain provisions. Rawad is not obligated to fulfill any written promise or commitment that is not expressly approved in writing by the authorized signatory.

19.2 If a provision of these Terms is found to be invalid or unenforceable for any reason under the applicable law, the remaining provisions shall remain valid and enforceable.

19.3 References to the singular shall include the plural and vice versa, and references to one gender do not mean restricting obligations or rights to such gender unless expressly stated otherwise.
